Some things never cease to amaze me, like this decision. It’s ridiculous. Splitting hairs to this degree is an affront to the dead John Lennon. Shame on you!
The main thrust of the sample is to advertise the iPod (which is hardware within Computer’s exclusive field of use) and no point is taken about the apple logo used in conjunction with that. There is, however, a reference to the ITMS. Nevertheless there is, I find, no breach in respect of this use.
The link between the logo and the references to the store is implicitly there but it is probably less than on the video adverts. In any event, the only possible link between the logo and musical recordings is via that link. The association between the logo and the download service is a proper one. The primary reason there is no breach is because there is no use of the logo in connection with recorded music for the purposes of the TMA – there is no association by way of trade within that agreement.

The Crab Nebula is the shattered remnant of a massive star that ended its life in a supernova explosion. Nearly a thousand years old, the supernova was noted in the constellation of Taurus by Chinese astronomers in the year 1054 AD.
This view of the supernova remnant obtained by the Spitzer Space Telescope shows an infrared view of this complex object. The blue-white region traces the cloud of energetic electrons trapped within the star’s magnetic field, emitting so-called “synchrotron” radiation. The red features follow the well-known filamentary structures that permeate this nebula. Though they are known to contain hot gasses, their exact nature is still a mystery that astronomers are examining.
The energetic cloud of electrons is driven by a rapidly rotating neutron star, or pulsar, at its core. The nebula is about 6,500 light-years away from the Earth, and is 5 light-years across.

Over at Techdirt they were quick to point out that Sony finally realized that people aren’t using 8Tracks, I mean ATRAC, their proprietary DRM solution. They even joke it’s from the “took-’em-long-enough dept.”
It’s been well over a year since Sony’s Ken Kutaragi admitted that Sony had made a huge strategic error in pushing its proprietary ATRAC music format (complete, of course, with copy protection). However, from admitting it to actually doing something about it takes time. Reports are coming out now, saying that Sony is going to allow its music players to play AAC formatted songs. A lot of the press seems to reporting this as Sony adopting “Apple’s” audio format — but that’s not really accurate.
AAC is a standard, not an Apple proprietary format. Apple does use a proprietary copy protection system called FairPlay on the songs it sells from iTunes — and they refuse to let anyone else offer FairPlay compatible systems… including Sony. So, this doesn’t actually mean you’ll be able to play iTunes music directly on Sony systems. It just means Sony is finally recognizing that their products need to play additional formats. Iowa State University – well, guess they have a lot of detailed data they need to review in virtual reality. What the heck are they using it for any way? It all seemed an impressive technological achievement, you eventually find it’s powered by 24 Sony Digital projectors and a server with 96 GPUs.
Iowa State University has just announced a $4 million overhaul of its so-called “C6″ virtual reality room that will enable a total of 100,000,000 pixels to be displayed on all six 10-foot by 10-foot surfaces in the room, and supposedly make it the most realistic environment of its kind in the world.
In use since June of 2000, C6 has served a role in projects for fields as diverse as urban planning, cell biology, and mechanical engineering, and is currently being funded by military grant money to develop a VR room which would enable a single operator to remotely view and control a squadron of unmanned planes. UFOs are continually rejected by the institution – worldwide. Russia seems to be opening up, but the UK is still clammed up on the subject. Oh they are talking, but talking crap..
The Ministry of Defense confirmed Sunday a secret study completed in December 2000 had found no evidence that “flying saucers” or unidentified flying objects were anything other than natural phenomena. The 400-page report, released under freedom of information laws to an academic from the northern city of Sheffield, concluded that meteors and unusual atmospheric conditions could explain UFO sightings such as bright lights in the sky.
“No evidence exists to suggest that the phenomena seen are hostile or under any type of control, other than that of natural physical forces,” the report said, according to extracts quoted by the BBC.
Remember the excitement as Charlie bought his Wonka chocolate bars, hoping to find the Golden Ticket? Well, you can have that experience all over again, instead, you gotta be in the UK and buy a Kit Kat. The ticket won’t get you to be the one who can go to the Wonka Factory, but instead get a chance to appear on “Big Brother,” attempting to get it’s ratings and excitement level up.
“Big Brother” is trying to find its very own Charlie Bucket, hiding golden tickets in KitKat bars that will win the finder entry to the hit reality TV show’s house. It is the first time a member of the public will be chosen at random to participate in the UK program, which generates big TV audiences and tabloid headlines for contestants.
There will be 100 golden tickets placed in KitKat bars distributed to 40,000 British retail outlets starting at 10:30 p.m. (2130 GMT) on May 18, Britain’s Channel 4 said Friday. The competition ends on June 2 at 10:20 p.m. (2120 GMT). Continue reading
